KOMMERSANT. THE INVESTIGATION DEALS WITH FAUX HANDICAPPED. A CRIMINAL CASE OF CORRUPTION IN THE MEDICAL AND SOCIAL EXPERTISE BUREAU WAS FILED TO THE INVESTIGATIVE COMMITTEE OF RUSSIA

A criminal case of corruption in the Bureau of Medical and Social Expertise (BMSE) for the Samara Region was received by the regional criminal investigations division of the Russian Federation Investigative Committee. The case is being investigated by officers of the Second Department for the investigation of particularly important cases of the regional criminal investigations division of the Russian Federation Investigative Committee. Earlier, it was initiated by officers of the military investigative division of the Russian Federation Investigative Committee for the Central Military District.

The crimes described in the criminal case were qualified under paragraph b, Part 4, Article 291 of the Criminal Code (bribery to an official), paragraph b, Part 3, Article 291.1 of the Criminal Code (mediation in large-scale bribery), paragraph c, Part 5, Article 290 of the Criminal Code (large-scale bribery by an official).

According to State Duma deputy Alexander Khinstein, we are talking about "numerous facts of bribes to employees of BMSE for receiving a false disability”. So far, the investigation has managed to prove three such crimes.

The total amount of the bribe was 1.65 million rubles. Alexander Khinshtein also suggested that employees of the Ministry of Health of the Samara region could be involved in the criminal scheme. According to the parliamentarian, "the search of the intermediary seized ‘black books’, which recorded more than ... 150 such operations."

Roman Voronin, Advocate and Managing Partner, of RI-Consulting, tells Kommersant about the prospects of the criminal case.

"The prospects of this criminal case are obviously judicial. Apparently, some specific facts are revealed, where there are bribe givers, intermediaries and bribe takers, i.e., those persons who were interested in this.

As for the black book, which contains a huge number of records, but there is no operational data about it, such facts can be proved quite easily. Now all the bribe givers indicated in this book will be invited by the investigative bodies and offered to voluntarily confess on bribe giving.

In accordance with the note to Article 291 Bribery, such a confess is an unconditional basis for them to terminate criminal proceedings on rehabilitative grounds. That is, they will not be prosecuted. And on the basis of this data and the records, it will be enough to prove the guilt of bribe takers.

If there are intermediaries, respectively, intermediaries will be invited in the same way, just maybe they will be more difficult to establish, because the identity of those who gave, you can obviously see them. So, I think it will be a very big criminal case, with many episodes and with the similar tactics of proving. We have repeatedly encountered this and, in principle, on the part of the investigating authorities it is a perfectly working and used approach, which then effectively passes the courts," said the Advocate.
